General terms and conditions of Sale for private mail orders

We only have one mailing address for mail orders: CORIMA S.A - Sortie Autoroute A7 - F-26270 – LORIOL – FRANCE.

PRICES

Prices are those mentioned in our internet web site and in our catalogues with additional delivery charges. Prices are subject to change without prior notice.

SHIPPING COSTS

Shipping costs are detailed for each item in the appropriate paragraph (see shipping costs).

SHIPPING

Our products are shipped at addresses’ own risks whichever the mode of transport chosen.
Our responsibility ceases when the products leave our factory.
It is the buyer’s responsibility to check the products and to make any reservations on delivery, and to make claim against the carrier within the time prescribed.

PAYMENT

  • By Credit card (shipping to the cardholder’s address)

  • By Bank transfer (swift)

DELIVERY TIME

  • The wheels and accessories will be delivered within one week.
  • The frames will be delivered within 4 weeks 
(these delivery times are given as an indication only).

THE WARRANTY OF OUR PRODUCTS

1 – THE CORIMA SALES WARRANTY

1-1 – The warranty

The CORIMA Company warrants all its products against any defects in material and workmanship for a duration of two (2) years from the product’s billing date. 
The repair periods covered by the sales warranty on the products will not extend the warranty’s duration unless the product is immobilized more than seven (7) days. In the latter case, this downtime will be added to the warranty’s still remaining term.

1-2 – Warranty’s limitation

The CORIMA warranty covers exclusively the manufacturing defects of its products and excludes, notably, from its scope of application any damage, prejudice and, more generally, any direct or indirect consequence which would result from bad use or failure to respect user instructions, the lack of maintenance or a non-conforming use of the product.

1-3 – Warranty’s application

In order to have the CORIMA sales warranty apply, the buyer should return the product for examination to the CORIMA Company at its headquarters’ postal address indicated on the letterhead of these sales conditions. The product must be accompanied with its invoice. The CORIMA Company will then proceed to examine the product. Depending on the results obtained, the following will be suggested:

  • If the product has a manufacturing defect, CORIMA will decide either to repair or replace the product or a part of the product in question.
  • If the product does not have a manufacturing defect, CORIMA will suggest to the buyer to repair or replace the product at the buyer’s expense.

Any return to CORIMA for examination will be handled by the customer who will ensure that the product’s packaging is appropriate, that the product is insured, if necessary, and that the shipping costs are paid.


This sales warranty applies without prejudice to the legal guarantees, particularly the guarantee of conformity provided by Article L.211-1 and subsequent articles of the French Consumer Code and the guarantee against latent defects provided for by Articles 1641 to 1649 of the French Civil Code.

2 – THE LEGAL GUARANTEES

2-1 Legal guarantee of conformity

In accordance with the provisions of Articles L.211-1 to L.211-14 of the French Consumer Code, from which extracts are given below, the consumer benefits from a legal guarantee of conformity:

Article l.211-4 :  The seller is obliged to deliver goods in conformity with the contract and will be responsible for the lack of conformity at the delivery time. He will also be responsible for the lack of conformity resulting from the packaging, mounting instructions or installation when the contract stipulates that the seller is in charge of the installation or the installation is performed under his responsibility.

Article l.211-5 : In order to conform with the contract, the goods must:

  1. be specific for the customary usage expected from comparable goods and, if necessary:
    • - correspond to the description given by the seller and have the qualities that the seller presented to the buyer in the form of a sample or model;
    • - have the qualities that a buyer can legitimately expect on account of the advertisements made by the seller, by the producer or by his representative, particularly in terms of publicity or labeling;
  2. Or have the characteristics defined by common agreement by the parties, or be specific to any special usage sought by the buyer, indicated by the buyer to the seller, and for which the seller has thereby agreed to.

Article l.211-12 : The legal guarantee of conformity shall be valid for two (2) years as of the goods delivery date.

2-2 Guarantee against latent defects

In accordance with the provisions of Articles 1641 to 1649 of the French Civil Code, from which extracts are given below, the buyer benefits from a guarantee against latent defects:

  • Article 1641 : le vendeur The seller is obliged to guarantee the item sold against latent defects which render it unsuitable for its intended usage, or reduce this usage to such an extent that the buyer would not have purchased the item, or that he would have purchased it only at a lower price if he had known the latent defects existed.
  • Article 1648 al. 1 : The buyer shall have two (2) years as of the discovery date of the latent defect(s) to apply the guarantee against latent defects.

THE « COMPLETE SATISFACTION OR FULL REFUND » RULE

The customer has seven (7) days to return all or part of his order (except tailored and/or customized products) for exchange or refund. To do this, the unused products should be correctly protected in their original packaging and be accompanied by their invoice. The exchange or refund will be taken into account only for the product at its original price excluding delivery costs from the moment when the product is returned in perfect condition to CORIMA in its original packagings with delivery costs paid.

RETURNING A PRODUCT TO THE CORIMA S.A. AFTER-SALES DEPARTMENT

Any return to CORIMA for examination will be handled by the customer who will ensure that the product’s packaging is appropriate, that the product is insured, if necessary, and that the shipping costs are paid.
Don’t forget to include the invoice with the wheel, as well as your name, address and phone number.


IMPORTANT! If you want to return your wheel to the CORIMA SA After-Sales Department, please make sure to return it without the tubular or clincher tire, without the pinions (sprockets) and without the quick release skewer.

AVAILABILITY

CORIMA will keep you informed by any means if the products ordered are not available. An approximate delivery time will be determined.

RETENTION OF OWNERSHIP

In accordance with the law 80-335 dated 12/05/1980, CORIMA S.A reserves the right of ownership to all products supplied until payment has been made in full. The ownership transfer is made once the buyer has paid in full. If payment is not done on time, the seller will get back the goods and will cancel the contract. The risks during shipping and delivery will be at the buyer’s charge even though the buyer is not the owner of the goods yet.

The buyer certifies to immediately pay back the price to the seller.
In accordance with the article 48 of the N.C.P.C, the only court of competent jurisdiction is the Commerce Court of ROMANS (26), FRANCE.
